29 CFR 1926.1053(b)(1): Where a portable ladder(s) was used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder. (a) On or about February 24, 2021, the telescoping multi-position ladder erected on the North side of the structure, and being used for access to the roof, did not extend at least three (3) feet above the landing edge, and/or was not secured to the structure when it was not sufficiently extended. This exposed employees accessing the roof to a fall hazard.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): (a) On or about February 24 2021, employees conducting roofing work on an 6:12 pitch roof on the South side of the structure. were not protected from falling to the lower level. This exposed employees to a fall hazard of approximately nine (9) feet four (4) inches. Barry's Construction, LLC company was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1501177, citation number 1, item number 1 and was affirmed as a final order on December 21st, 2020, with respect to a workplace located at 2171 Langford Ln. WHEATON, IL 60187.
