29 CFR  OSH ACT of 1970 Section (5)(a)(1):  The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or were likely to cause death or serious physical harm to employees in that employees were exposed to struck-by or crushing hazards when operating all-terrain forklifts without the use of a restraint device:  New townhome construction located on Lots 29-33 Courtland Road, Milton, GA 30004, Courtland Road: On 03/04/2021 employees operated the JLG (Model 5042) All-Terrain telehandler without a seatbelt.

29 CFR  1926.602(d): The employer did not certify that each operator had been trained and evaluated as required by paragraph 29 CFR 1910.178(l):  New townhome construction located on Lots 29-33 Courtland Road, Milton, GA 30004: On or about 03/17/2020, and at times prior, the employer exposed employees to struck-by hazards, in that employees were operating a JLG 5042 All-Terrain Forklift Truck without first receiving training and certifications to operate this equipment. Uncertified operators were in close proximity to others working on the street and other material lay down areas.

29 CFR  1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   a) New townhome construction located on Lots 29-33 Courtland Road, Milton, GA 30004, Rear side of unit #31: On or about 03/04/2021, the employer exposed employees to falls of 23-feet, 6-inches to the lower level while working from a 10/12 pitched roof and top plate, in that a complete fall protection system was not used as the employee was not connected to a life-line or lanyard while engaged in framing and sheathing activities.   b) New townhome construction located on Lots 29-33 Courtland Road, Milton, GA 30004, Rear side of unit #31 and unit #32: On or about 03/04/2021, the employer exposed employees to falls of 12-feet, 4-inches to the lower level, in that employees were not provided with a fall protection system while using the rear decks as a walking working surface engaged in framing activities.

29 CFR  1926.1051(a): Stairway(s) or ladder(s) were not provided at all personnel points of access where there was a break in elevation of 19 inches (48 cm) or more, or no ramp, runway, sloped embankment, or personnel hoist was provided:    a) New townhome construction located on Lots 29-33 Courtland Road, Milton, GA 30004, Rear side of unit #31: On or about 03/04/2021, the employer exposed employees to falls of 10-feet, 4-inches to the lower level while using the guardrail and the 2x4 bracing as a means of access to the upper work landing, in that a ladder was not provided for safe access to the top plates to install roof sheathing.
