29 CFR  1926.451(e)(1): When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface shall be used. Crossbraces shall not be used as a means of access.  a. On or about March 17, 2021, an employee climbed the side of a walk-thru supported scaffold frame as a means to access the scaffold platform. The employer did not ensure that an approved access ladder was utilized, thereby exposing the employee to a fall hazard of up to approximately 35 feet.

29 CFR  1926.454(a): The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The training shall include the following areas, as applicable:   29 CFR  1926.454(a)(3):The proper use of the scaffold, and the proper handling of materials on the scaffold;  a.	On or about March 17, 2021, the employer did not ensure that the employee climbing the side of a walk-thru supported scaffold frame in order to access the scaffold platform had been adequately trained on the proper use of the scaffold and approved methods of access.
