29 CFR OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: The employer is failing to protect employees from crushing and struck by hazards associated with working beneath metal storage racks used to hold palletized material. This was most recently documented at Plant 10 of the facility located at North Highway 50, Pawnee City, Nebraska on or about March 18, 2021. Where the employer has employees working beneath metal storage racks without impact protection and powered industrial trucks placing and removing material from the racks. AMONG OTHER METHODS, FEASIBLE AND ACCEPTABLE ABATEMENT METHODS TO CORRECT THIS HAZARD ARE: 1) Install impact protection at the ends of aisles to prevent racking uprights from being struck. 2) Train employees to recognize the dangers of using come along devices and to evaluate any hazards in regard to striking racking uprights. 3) Develop a process where employees picking inventory are not under any racking.

29 CFR 1910.178(l)(3)(i)(I): The employer did not provide powered industrial truck training applicable to safe operation regarding vehicle stability: The employer is failing to train employees that were potentially exposed crushing and struck by hazards. This was most recently documented at North Highway 50, Pawnee City, Nebraska on or about March 18, 2021. The employer is failing to ensure that each employee is trained to recognize the hazards associated with vehicle stability while loading and unloading metal racks with palletized materials. Vertical supports of the racks were deformed and bent because of employees striking them while operating powered industrial trucks.
