29 CFR 1926.150(a)(1): The employer did not develop and maintain a fire protection program to be followed throughout all phases of construction and demolition work, and did not provide for the firefighting equipment as specified in this subpart: a) Lot 97 Arbor-Lyn Development Rehoboth Beach, DE: On or about March 24, 2021, the employer did not provide any type of fire protection program to ensure that proper fire protection was addressed and the employees knew what to do in the event of a fire.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502: a) Lot 97 Arbor-Lyn Development Rehoboth Beach, DE: On or about March 24, 2021, the general contractor failed to ensure each subcontractor's employee was protected from falls standing at the edge of the unguarded deck with an approximate fall height of 12 feet to lower level.
