29 CFR 1926.20(b)(2): The employer did not initiate and maintain an accident prevention program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them): (a)Clark Drew Construction, Inc. at 1815 6th Street, Brookings, SD 57006: On or about and at times prior to March 26, 2021, the controlling employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. Employees and subcontractor employees were exposed to fall hazards related to conducting roofing operations on a flat roof measuring 15 feet in height. Employees were operating a rough terrain forklift with extremely worn tires that were missing tread and steel belts showing. This condition exposed employees to fall hazards and improperly operating a rough terrain forklift. Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.

29 CFR 1926.501(b)(1):Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: (a)Drew Clark Construction, Inc. at 1815 6th Street, Brookings, SD 57006: On or about and at times prior to March 26, 2021, the exposing employer did not ensure the employees were protected from fall hazards while working on the roof of a commercial building under construction. Employees were sheathing a parapet wall on the roof without a fall protection system. This condition exposed employees to a fall hazard of approximately 15 feet.

(a)Clark Drew Construction, Inc. at 1815 6th Street, Brookings, SD 57006: On or about and at times prior to March 26, 2021, the controlling and exposing employer did not ensure employees were protected from falls through holes on the walking/working surface. Employees and subcontractor employees were exposed to fall hazards associated with a hole approximately 40 inches wide by 60 inches long in the roof associated with a roof penetration for an HVAC system. This condition exposed employees and subcontractor employees to a fall hazard of approximately 15 feet to the interior of the building.

29 CFR 1926.602(c)(1)(vi):All industrial trucks did not meet the applicable requirements of design, construction, stability, inspection, testing, maintenance, and operation, as defined in American National Standards Institute B56.1-1969, Safety Standards for Powered Industrial Trucks: (a)Clark Drew Construction, Inc. at 1815 6th Street, Brookings, SD 57006: On or about and at times prior to March 26, 2021, the controlling and exposing employer did not ensure the rough-terrain forklift being used on the project to lift materials to the roof met the applicable requirements regarding safe operation. A Ingersoll Rand VR 642C rough terrain forklift had all four tires that were severely worn and showing the steel belts. This condition exposed employees to struck-by hazards related to improper forklift operation.
