29 CFR 1926.1101(k)(9)(ii):Training was not provided prior to or at the time of initial assignment and/or at least annually thereafter for employees likely to be exposed in excess of a permissible exposure limit (PEL) and for employees performing Class I through IV asbestos operations: 1) On March 20, 2021, an employee conducted Class III work while collecting bulk samples of asbestos containing materials. Annual refresher training provided by the employer did not include a hands on portion that met the requirements of paragraph 1926.1101(k)(9)(v) of this section.
