29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   Jobsite:  The employer did not ensure that employees who were exposed to a fall hazard when installing asphalt shingles on the roof were protected by the use of guardrails, safety nets or personal fall arrest systems.  On or about 23 April 2021 an employee suffered fatal injuries from a fall while re-roofing.  Alejandro Rodriguez was previously cited for a violation of an equivalent Occupational Safety and Health Standard 19266.501(b)(10), which was contained in OSHA inspection number 1209777, citation number  1, item number 1 and was affirmed as a final order on 4 Sep 2021, with respect to a workplace located at 2030 Memorial Park Road Gainesville, GA  30504.

29 CFR  1926.95(d)(1):Except as provided by paragraphs (d)(2) through (d)(6) of this section, the protective equipment, including personal protective equipment (PPE), used to comply with this part, was not provided by the employer at no cost to employee(s).  Jobsite: The employer required the employees to pay for and provide their own personal fall arrest systems (PFAS) who were exposed to fall hazards when performing roofing work.
