29 CFR 1926.102(a)(1):Eye and face protective equipment were not used when machines or operations presented potential eye or face injury: a) New residential construction, LOT 11, Roof: On or about 4/28/2021, the employer exposed employees to struck by hazards , in that they are operating a Metabo HPT NV45AB2 1-3/4 coil nail gun at 125 PSI without eye protection. Safety glasses were not provided to employees while conducting roofing activities prior to the beginning of the work day.

29 CFR 1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: a) New residential construction, LOT 11, Roof: On or about 4/28/2021, the employer exposed employees to fall hazards , in that a complete fall protection system was not provided to employees who were conducting roofing activities on a 8:12 pitched roof at heights measured at 23 feet 4 inches to the lower level. Employees were installing shingles on the roof.
