29 CFR 1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: a) New residential construction; Lot 20; Roof: On or about 9/2/2021, and at times prior, the employer exposed employees to fall hazards, in that a complete fall protection system was not provided to an employee who was installing shingles on a 10:12 pitched roof at heights measured at 14 feet to the lower level.

29 CFR 1926.552(a)(1):The employer did not comply with manufacturer's specifications and limitations applicable to the operation of all hoists and elevators: (a) New residential construction; Lot 20; Front of residence to roof: On or about 9/2/2021, the employer exposed employees to fall hazards in that the employer allowed employees to use the TranzSporter (Model LH250) Platform Hoist as a ladder to access the roof to install shingles. The manufacturer's general safety instructions state that this hoist should never be used as a ladder.
