29 CFR 1926.102(a)(1):Eye and face protective equipment were not used when machines or operations presented potential eye or face injury: a) New residential construction, LOT 54, Roof: On or about 6/24/2021, the employer exposed employees to struck by hazards , in that they are operating a Metabo HPT NV45AB2 , 1-3/4 coil nail gun at 175 PSI without eye protection. Safety glasses were not provided to employees while conducting roofing activities prior to the beginning of the work day.

29 CFR 1926.302(b)(5):The manufacturer's safe operating pressure for hoses, pipes, valves, filters, and other fittings were exceeded. (a) New residential construction, Lot 54, roof : On or about 6/24/2021, and at times prior, the employer exposed employees to struck by hazards , in that they are operating a pneumatic Metabo NV45AB2 1 3/4 inch strip Nail Gun at 175 PSI . The operating air pressure for this tool is between 70-120PSI. The Rolair model MDL4090HK17-0279, SER# 20123751 air compressor regulator was showing 175 PSI. Employee were installing shingles

29 CFR 1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: a) New residential construction, LOT 54, Roof: On or about 6/24/2021, the employer exposed employees to fall hazards , in that a complete fall protection system was not provided to employees who were conducting roofing activities on a 14:12 pitched roof at heights measured at over 25 feet to the lower level. Employees were installing shingles on the roof.
