29 CFR 1910.95(b)(1):When employees were subjected to sound exceeding those listed in Table G-16, feasible administrative controls were not utilized: Alfred Nickles Bakery, Inc. located at 1950 North Sugar Street in Lima, Ohio 45801. On or about June 16, 2021, the employer did not utilize administrative controls to reduce employees' 8 hour time weighted average (TWA) exposure to sound levels below the permissible exposure limit of 90 decibels. Employees were expose to hazards associated with high noise levels such as, but not limited to, short and long term hearing loss. a) An employee operating the KID at line #4 was exposed to noise during the 426 minute sampling period on June 16, 2021 at an 8 hour TWA of 92.8 dBA. b) An employee operating the KRD at the 600 divider was exposed to noise during the 474 minute sampling period on June 16, 2021 at an 8 hour TWA of 92.2 dBA.

29 CFR 1910.95(c)(1):The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a) Alfred Nickles Bakery, Inc. located at 1950 North Sugar Street in Lima, Ohio 45801. On or about June 16, 2021 the employer did not ensure that a continuing and effective hearing conservation program was implemented when employee noise exposures equaled or exceed an 8 hour time-weighted average sound level of 85 decibels. Employees were exposed to hazards associated with high noise levels such as, but not limited to, short and long term hearing loss.
