29 CFR  1910.147(c)(7)(i)(A):Authorized employee(s) did not receive training in the recognition of applicable hazardous energy sources, the type and magnitude of the energy available in the workplace, and the methods and means necessary for energy isolation and control:  a. Alfred Nickles Bakery, Inc. - Lima, Ohio: On or about May 6, 2023, the employer did not ensure that employees who maintain the #5 UBE 400 Line were trained in the skills required for the safe application, usage, and removal of energy controls.  Employees were not trained to isolate and render energy controls safe prior to performing cleaning tasks.   b. Alfred Nickles Bakery, Inc. - Lima, Ohio: On or about May 7, 2023, the employer did not ensure that employees who maintain the #5 UBE 400 Line were trained in the skills required for the safe application, usage, and removal of energy controls.  Employees were not trained to isolate and render energy controls safe prior to setting up the machine's hinge slice blades.  c. Alfred Nickles Bakery, Inc. - Lima, Ohio: On or about May 4, 2023, the employer did not ensure that employees who maintain the #4 UBE 400 Line were trained in the skills required for the safe application, usage, and removal of energy controls.  Employees were not trained to isolate and render energy controls safe prior to performing cleaning tasks.   d. Alfred Nickles Bakery, Inc. - Lima, Ohio: On or about May 11, 2023, the employer did not ensure that employees who maintain the #4 UBE 400 Line were trained in the skills required for the safe application, usage, and removal of energy controls.  Employees were not trained to isolate and render energy controls safe prior to unjamming and setting up the machine's bagger.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR  1910.147(d):The established procedure for the application of energy control (the lockout or tagout procedures) did not cover the actions listed in and was not done in sequence as required by 29 CFR 1910.147(d)(1)-(6):  a. Alfred Nickles Bakery, Inc. - Lima, Ohio: On or about May 6, 2023, employees were exposed to amputation injury in that the band slicer, located at the #5 UBE 400 Line, was not locked out during cleaning activities.  An employee sustained a partial finger amputation when cleaning breadcrumbs from the machine. The employer did not ensure that energy control application steps, to control the machine's electrical/mechanical energy source, were implemented prior to employees accessing the hazard area to clean the equipment - the employer did not:  - Ensure employees had the method or means to control hazardous energy. - Ensure that equipment was turned off or shut down. -Physically operate energy isolating devices to control energy sources and affix lockout device(s). - Ensure that all potentially hazardous stored or residual energy was relieved, disconnected, and rendered safe. - Verify that isolation and deenergization of the machine or equipment had been accomplished.  b. Alfred Nickles Bakery, Inc. - Lima, Ohio: On or about May 7, 2023, employees were exposed to amputation injury in that the hinge slice blades, located at the #5 UBE 400 Line, were not locked out during setup activities. The employer did not ensure that energy control application steps, to control the machine's electrical/mechanical energy source, were implemented prior to employees accessing the hazard area to setup the blades - the employer did not:  - Ensure employees had the method or means to control hazardous energy. - Physically operate energy isolating devices to control energy sources and affix lockout device(s). - Ensure that all potentially hazardous stored or residual energy was relieved, disconnected, and rendered safe. - Verify that isolation and deenergization of the machine or equipment had been accomplished.  c. The employer did not ensure that energy control application steps, to control the machine's pneumatic and electrical/mechanical energy sources, were implemented prior to employees accessing the hazard area to unjam, load/setup the bagger - the employer did not:  - Ensure employees had the method or means to control hazardous energy. - Physically operate energy isolating devices to control energy sources and affix lockout device(s). - Ensure that all potentially hazardous stored or residual energy was relieved, disconnected, and rendered safe. - Verify that isolation and deenergization of the machine or equipment had been accomplished. Employees have the right to report work-related injuries and illnesses;  b.	Employers are prohibited from discharging or in any manner discriminating against employees for reporting work- related injuries or illnesses.
