(i) Except as provided elsewhere in this section, the employer must ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the following:    Work shop - On or about May 5, 2021 and times prior thereto, employer did not ensure that employees storing including, but not limited to boxes and motor parts into the storage loft were protected from falls of approximately 10 feet and 1 inch to the concrete below when no fall protection was utilized.

29 CFR  1910.157(c)(1):Portable fire extinguishers were not mounted, located and identified so that they were readily accessible without subjecting the employees to injuries:  On or about May 5, 2021 and times prior thereto,  portable fire extinguishers located in the workshop area were not securely mounted in a conspicuous and labelled area in the following employee accessible work areas:  a) Top of stairwell leading into storage loft area b) On floor in service area adjacent to emergency eye wash station.

29 CFR  1910.178(a)(4):Modifications and additions which affect capacity and safe operation shall not be performed by the customer or user without manufacturers prior written approval. Capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly.  On or about May 5, 2021 and times prior thereto, the employer did not ensure that all modifications made to the Caterpillar Forklift Model 2P5000 were approved by the manufacturer when a hole was drilled into one of the forks for pulling, including but not limited to, trailers that exposed employees to the possible roll-over hazards.

29 CFR  1910.178(l)(1)(i):The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l).  On or about May 5, 2021 and times prior thereto, the employer did not ensure that all employees that operated the powered truck forklift at the shop (Caterpillar Forklift Model 2P5000 ) were trained and deemed competent by completing the required training program and evaluation.
