29 CFR  1926.20(b)(1):The employer did not initiate and maintain such programs as may be necessary to comply with the standards set forth in 29 CFR 1926 as evidenced by the violation(s) noted during the course of the inspection.  On or about May 6, 2021, the employer did not initiate and maintain a safety program for employees, exposing employees to various construction hazards such as but not limited to fall from heights and eye injuries.

29 CFR  1926.503(a)(1):The employer did not provide a training program for each employee who might be exposed to fall hazards, which would enable each employee to recognize the hazards of falling and train each employee in the procedures to be followed in order to minimize these hazards.  On or about May 6, 2021 and at times prior thererto, four employees were performing roofing operations without the use of fall protection and without fall protection training, exposing the employees to a fall hazard of approximately 16 feet to the ground below.

29 CFR  1926.102(a)(1):The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  On or about May 6, 2021 at at times prior thereto, five employee were using a pneumatic nail gun to secure decking to a roof without wearing appropriate eye protection, exposing the employees to the hazard of being struck in the eye(s) by flying debris or projectiles.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b).  On or about May 6, 2021, and at times prior thereto, five employee were removing shingles from a roof of a residential home under construction up to approximately 16 feet high without fall protection, exposing the employees to a fall hazard.

29 CFR  1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed.  On or about May 6, 2021, roofers accessed the roof of a two story house by using a portable ladder whose side rails did not extended at least 3 feet above the upper landing surface, exposing the roofers to a fall hazard of approximately 8 feet to the ground below.
