29 CFR  1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns:  a. On or about 05/11/2021- #7 Milford Lane, Suffern NY 10901- Employees engaged in roof removal and sheathing activities were discarding roofing debris  from the roof to the ground below exposing employees at ground level to overhead impact hazards as head protection was not being utilized.   b. On or about 05/11/2021 #7 Milford Lane, Suffern NY 10901- Sheets of plywood were being conveyed to the roof by a material hoist exposing employees both operating and receiving the plywood sheets to overhead impact hazards as head protection was not utilized.

29 CFR  1926.102(a)(1): Employees did not use eye and face protection equipment when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:   a. On or about 05/11/2021- #7 Milford Lane, Suffern NY 10901- Employees were engaged in roof removal and sheathing activities using pneumatic nail guns were exposed to eye loss and eye injuries due to flying debris as eye protection was not utilized.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system.   The employer does not require the use of any form of fall protection when employees are performing residential construction activities 6 feet or more above lower levels. The violation was recently observed on or about May 11, 2021, at a residential construction site located at or near #7 Milford Lane, Suffern, New York 10901, where three employees were not protected from fall hazards of approximately twenty feet to the ground. To abate this violation, the employer must ensure that its employees performing residential construction activities 6 feet or more above lower levels are protected from falls, and that no employee is allowed to perform residential construction activities at heights greater than 6 feet above lower levels without adequate fall protection.  Pursuant to 29 CFR 1903.19, within 30 days the employer must submit documents describing the steps it is taking to ensure Compliance, including a description of how these steps protect its employees from fall hazards.
