29 CFR  1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs, with unprotected sides and edges 6 feet (1.8 m) or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest system, or warning line system and safety monitoring system:  (a) On or about May 13, 2021, and at times prior, Legendary Roofing, Inc., as the controlling and exposing employer, did not protect employees of Legendary Roofing, Inc. and Calderon Roofing, LLC, sub-contractor, from fall hazards in excess of 30 feet and greater while removing metal sheeting on a commercial roof.  Abatement Note:  Abatement certification and documentation are required for this item (see enclosed "Certification of Corrective Action Worksheet"). Legendary Roofing, Inc.,  was previously cited for a violation of this occupational safety and health standard or its equivalent standard (29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1181232, citation number 1 item number 1 and was affirmed as a final order on November 7, 2016, with respect to a workplace located at 5955 Desoto Dr, Colorado Springs, CO 80916. 29 CFR  1926.252(a): An enclosed chute of wood, or equivalent material, was not used where materials were dropped more than 20 feet to points lying outside the exterior walls of the building(s):  (a)  On or about May 13, 2021, and at times prior, Legendary Roofing, Inc., sub-contractor, exposed two employees and employees of Calderon Roofing, LLC, sub-contractor, to struck by hazards where an enclosed chute or equivalent, was not provided for metal sheeting that was dropped more than 30 feet from  the roof of a commercial building to the ground. 29 CFR  1926.501(c)(3): The employer did not barricade the area to which objects could fall, did not prohibit employees from entering the barricaded area, and did not keep objects that could fall far enough away from the edge of a higher level so that  those objects would not go over the edge if they were accidentally displaced:  (a)  On or about May 13, 2021, and at times prior, Legendary Roofing, Inc., exposed two employees and two employees of Calderon Roofing, LLC, to struck by hazards where metal sheeting  was dropped more than 20 feet from  the roof of a commercial building to an area on the ground that was not barricaded.
