29 CFR 1910.134(f)(1): The employer did not ensure that employee(s) required to use a tight-fitting facepiece respirator passed the appropriate qualitative fit test (QLFT) or quantitative fit test (QNFT): a) Granite Cutting Area: On or about May 20, 2021, and at times prior, the employer exposed employees to airborne silica hazards, in that a fit test had not been provided to employees required to wear respirators such as, but not limited to, a "Honeywell" model 7700-80 half- face respirator with HEPA cartridges while wet-polishing and wet-cutting granite slabs.

29 CFR 1910.1053(c):The employer did not ensure that no employee was exposed to an airborne concentration of respirable crystalline silica in excess of 50 micrograms per cubic meter, calculated as an 8-hour time-weighted average (TWA): a) Granite Cutting Area: An employee wet-polishing granite slabs was exposed to silica at 54.2 micrograms per cubic meter with a permissible exposure limit of 50.0 micrograms per cubic meter during the 421 minute sampling period on June 3, 2021. The exposure calculation included a zero increment for the 59 minutes not sampled. b) Granite Cutting Area: An employee wet-polishing granite slabs was exposed to silica at 297.5 micrograms per cubic meter with a permissible exposure limit of 50.0 micrograms per cubic meter during the 419 minute sampling period on June 3, 2021. The exposure calculation included a zero increment for the 61 minutes not sampled.
