29 CFR  1926.100(a):Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns:  (a)Genuine Builders, Inc. at 57th and Dubuque Avenue, Sioux Falls, SD 57110:  On or about and at times prior to May 24, 2021, the exposing employer did not ensure that employees were protected from overhead hazards such as tools and materials while conducting framing operations on a residential property.   This condition exposed employees to overhead struck-by hazards while working underneath upper level framing operations.

29 CFR  1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift:  (a)Genuine Builders, Inc. at 57th and Dubuque Avenue, Sioux Falls, SD 57110:  On or about and at times prior to May 24, 2021 the employer did not ensure that employees that were working from the basket of the JLG 460SJ Aerial lift were protected from falls by the use of a fall protection system.  This condition exposed employees to fall hazards while working within the basket of the lift.

29 CFR  1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employees provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   (a)  Genuine Builders, Inc. at 57th and Dubuque Avenue, Sioux Falls, SD 57110:  On or about and at times prior to May 24, 2021, the exposing employer did not ensure that employees conducting framing operations on a multi-family residential duplex were protected from fall hazards by a fall protection system.  This condition exposed employees to fall hazards greater than 10 feet.

29 CFR  1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  (a)Genuine Builders, Inc. at 57th and Dubuque Avenue, Sioux Falls, SD 57110:  On or about and at times prior to May 24, 2021 the employer did not ensure that the Keller model number 978, 8 foot A-Framed ladder being utilized on site for access to the upper level of the duplex were extended at least three feet above the upper landing surface being accessed.  This condition exposed employees to fall hazards associated with ladder access.

29 CFR  1926.1053(b)(4):Ladders shall not be used for purposes other than the purpose for which they are designed:  (a)Genuine Builders, Inc. at 57th and Dubuque Avenue, Sioux Falls, SD 57110:  On or about and at times prior to May 24, 2021 the employer did not ensure that ladders being utilized on site for access to the upper level of the duplex were extended and locked in that employees were utilizing the Keller model number 978, 8 foot A-Framed ladder to gain access to the upper level of the duplex by leaning the ladder against the lower level framing.  This condition exposed the employees to fall hazards associated with the improper set up of the A-framed ladder.

29 CFR  1926.1053(b)(13):The top or top step of a stepladder was used as a step:  (a)Genuine Builders, Inc. at 57th and Dubuque Avenue, Sioux Falls, SD 57110:  On or about and at times prior to May 24, 2021, the employer did not ensure that the top step of the 8 foot Keller model 978 A-framed step ladder was not being used as a step.  Employees were accessing the top step of the ladder while transitioning from the second level of the duplex.  This condition exposed the employees to a fall hazards associated with utilizing the top step of the ladder.
