29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s): (a) Genuine Builders, Inc. at 5300 East 57th Street, Sioux Falls, SD 57108: On or about and at times prior to November 2, 2021 the exposing employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. This condition exposed employees to a variety of hazards identified on site. Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.

29 CFR 1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employees provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): (a) Genuine Builders, Inc. at 5300 East 57th Street, Sioux Falls, SD 57108: On or about and at times prior to November 2, 2021, the exposing employer did not ensure that employees conducting roof sheathing operations on a multi-family residential duplex were protected from fall hazards by a fall protection system. This condition exposed employees to fall hazards greater than 19 feet. (b) Genuine Builders, Inc. at 5300 East 57th Street, Sioux Falls, SD 57108: On or about and at times prior to November 2, 2021, the exposing employer did not ensure that employees conducting framing operations on a multi-family residential duplex were protected from fall hazards by a fall protection system. This condition exposed employees to fall hazards greater than 10 feet. Genuine Builders, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1533100, citation number 1, item number 3 and was affirmed as a final order on October 6, 2021, with respect to a workplace located at 57th and Dubuque Avenue, Sioux Falls, SD.
