29 CFR 1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that was 4 feet (1.2 m) or more above a lower level was protected from falling by one or more of the following: Guardrail systems, safety net systems, or personal fall arrest systems: On or about May 20, 2021, employees were exposed to fall hazards approximately 8 feet, 3 inches while engaged in manufacturing a rotary machine. Fall protection equipment was not being utilized. The violation most recently occurred on or about May 20, 2021, when an employee was not protected from falls and suffered a head injury and vertebral fractures. No abatement certification or documentation required for this item.

29 CFR 1910.30(a)(1):(a) Fall hazards. (1) Before any employee is exposed to a fall hazard, the employer must provide training for each employee who uses personal fall protection systems or who is required to be trained as specified elsewhere in this subpart. Employers must ensure employees are trained in the requirements of this paragraph on or before May 17, 2017. On or about May 20, 2021, employees engaged in manufacturing a rotary machine were exposed to fall hazards approximately 8 feet, 3 inches with no fall protection when the employer failed to ensure they were adequately trained to recognize and minimize the hazards associated with falls. Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).

29 CFR 1910.132(h)(1):Except as provided by paragraphs (h)(2) through (h)(6) of this section, the protective equipment, including personal protective equipment (PPE), used to comply with this part, shall be provided by the employer at no cost to employees. On or about May 20, 2021, the employer did not provide protective welding helmets and welding jackets at no cost to the employees. The employer required employees to purchase and provide their own welding helmets and jackets. Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).
