29 CFR  1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:   a. At a temporary workplace, on the roof decking area of a new construction residence, located at of near 1067 Dania Circle (Lot 8) in Palm Bay, Florida:  Employees performing framing work are not protected from fall hazards by the use of a fall protection system.  The employer fails to assure effective protections against falls as required by the standard, as demonstrated on June 9, 2021, when four employees working on top of a structure nailing trusses, plywood and framing pieces on a new construction site located at  1067 Diana Circle (Lot 8) in Palm Bay in Florida, are exposed to an 8 foot, 8-inch fall hazard to the ground without the use of a personal fall protection system.  The Bluewater Construction Solutions, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(1), which was contained in OSHA inspection number 1429901, citation number 1, item number 1-A and was affirmed as a final order on December 5, 2019, with respect to a workplace located at 5610 SE Grouper Avenue, Stuart, Florida, 34997.

29 CFR  1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a.  At the temporary workplace of a new construction residence, located at of near 1067 Dania Circle (Lot 8) in Palm Bay, Florida: On or about June 9, 2021, the employer exposed employees to fall hazards ranging from 6 to 8-foot, 8-inches, in that a 20-foot Werner brand extension ladder used to access the roof area was not extended 3-foot above the upper landing, while employees climbed and descended the ladder.  Bluewater Construction Solutions, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.1053(b)(1), which was contained in OSHA inspection number 1429901, citation number 01, item number 002A and was affirmed as a final order on November 5, 2019, with respect to a workplace located at 5610 SE Grouper Avenue, Stuart, Florida, 34997.
