29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a) 5782 Bartell Road, Brewerton, NY  13029, on or about 6/16/21:  Workers were installing a roof on a 4:12 pitch roof with a ground to eave height of 12 feet without fall protection of any kind.    b) 5782 Bartell Road, Brewerton, NY  13029, on or about 6/16/21:  A worker was installing a roof onto a 2:12 pitch shed roof with a ground to eave height of 8 feet without fall protection of any kind.  Michael C. Graham & Sons Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard (CFR 1926.501(b)(13)), which was contained in OSHA inspection number 1253285, citation number 2, item number 1 and was affirmed as a final order on 3/28/18, with respect to a workplace located at 797 Rt. 37, Brewerton, NY.  Michael C. Graham & Sons Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard (CFR 1926.501(b)(13)), which was contained in OSHA inspection number 1253307, citation number 1, item number 1 and was affirmed as a final order on 10/5/17, with respect to a workplace located at 5504 Kathan road, Brewerton, NY.

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:   a) 5782 Bartell Road, Brewerton, NY  13029, on or about 6/16/21:  Workers were installing a roof on a 4:12 pitch roof with a ground to eave height of 12 feet and using an extension ladder to access the roof that did not extend at least 3 feet above the upper landing.    Michael C. Graham & Sons Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard (CFR 1926.501(b)(13)), which was contained in OSHA inspection number 1253285, citation number 1, item number 1 and was affirmed as a final order on 3/28/18, with respect to a workplace located at 797 Rt. 37, Brewerton, NY.
