29 CFR 1910.147(d): The established procedure for the application of energy control (the lockout or tagout procedures) was not done in sequence to achieve energy control by performing the following steps as required by 29 CFR 1910.147(d)(1)-(6): 1.	Turn off and shut down power to the machinery, 2.	Physically locate and operate energy-isolating devices in such a manner as to isolate the machine or equipment from the energy source(s), 3.	Affix lockout/tagout devices to each energy isolating device, 4.	Verify isolation and de-energization of machinery have been accomplished prior to starting the maintenance and/or servicing work:  a) Small Header Department- On or about June 16, 2021, employees were exposed to machine hazards associated with moving parts while performing maintenance and servicing tasks on National Small Header machine, such as performing setups, installing dies, changing fingers, upset, and hammer, removing jammed material, and cleaning threads. The employer did not implement energy control application steps as the machine was not shut down and deenergized to perform setup or adjustments [per the 1910.147(d)(2) requirements]. As a result, the remaining applicable energy control elements, involving dissipation machine isolation [(d)(3)], LOTO device application [(d)(4)], dissipation of residual energy [(d)(5)(i)], and verification of isolation [(d)(6)], were not implemented to protect employees from machine servicing hazards.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement or other written records.

29 CFR 1910.212(a)(2): Guard(s) on machine(s) were not affixed to the machine or secured elsewhere when attachment to the machine was not possible:  a) Small Header Department- On or about June 16, 2021, the employer did not ensure that all guards on machines, such as the National Small Header machines 6704 and 6705, were affixed and/or secured in a manner that would prevent employees from having any part of their body in the point of operation danger zone during the operating cycle. The guard for the point of operation was not secured or interlocked to prevent employees from accessing the area during normal production.  b) Small Header Department- On or about June 16, 2021, the employer did not ensure that all guards on machines, such as the National Small Header machines 6704 and 6705, were affixed and/or secured in a manner that would prevent employees from having any part of their body in a pinch point danger zone during the operating cycle. The guard for the speed roller was not secured or affixed to the machine to prevent it from being removed during normal production.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement or other written records.

29 CFR 1910.147(f)(1)(ii): When lockout or tagout devices temporarily were removed from the energy isolating device and the machine or equipment was energized to test or position the machine, the employees were not removed from the machine or equipment area in accordance to the paragraph (e)(2):  a) Small Header Department- On or about June 11, 2021, the employer did not ensure that all employees were safely positioned or removed while performing troubleshooting, testing, or positioning on machines or equipment, such as the National Small Header 6704.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement or other written records.
