29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: (a) On or about June 24, 2021, an employee was exposed to a fall hazard of 11 feet six (6) inches while installing facia board, when the ladder side rails did not extend at least 3 feet above the landing area.

1926.503(c)(3) Inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill. Note: The following appendices to subpart M of this part serve as non-mandatory guidelines to assist employers in complying with the appropriate requirements of subpart M of this part. [59 FR 40738, Aug. 9, 1994; 60 FR 5131, Jan. 26, 1995] 29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. (a) On or about June 24, 2021, an employee was exposed to a fall hazard of ~11 feet six (6) inches while installing facia board, and while working in-between roof trusses without fall protection. K & H Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard (29 CFR 1926.501(b)(13)), which was contained in OSHA inspection number 1504653, citation number 2, item number 1b and was affirmed as a final order on May 17, 2021, with respect to a workplace location at W143 N1139 Wrenwood Drive, Germantown, WI 53022. K & H Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard (29 CFR 1926.501(b)(13)), which was contained in OSHA inspection number 1456128, citation number 1, item number 1 and was affirmed as a final order on February 26, 2020, with respect to a workplace location at 35213 Castle Park Drive, Oconomowoc, WI 53066.
