1926.20(b)(2)  The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site:  (a)Thunder Ridge Construction, LLC at  7436 Twin Pines Court, Sioux Falls, SD 57110:  On or about and at times prior to June 29, 2021, the employer did not ensure employees were using appropriate eye protection when pneumatic nail guns were used during framing operations.  The condition exposed employees to the hazard of projectiles to the eye.

29 CFR  1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employees provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   (a)Thunder Ridge Construction, LLC at  7436 Twin Pines Court, Sioux Falls, SD 57110:  On or about and at times prior to June 29, 2021, the employer did not ensure employees were protected from falls while conducting framing operations during the construction of a single-family home.  Employees were working on the exterior top plate  while setting trusses on the second-story with no fall protection systems in place. This condition exposed employees to fall hazards greater than 18 feet.  Abatement Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.

29 CFR  1926.503(a)(1): The employer did not provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards:   (a)Thunder Ridge Construction, LLC at  7436 Twin Pines Court, Sioux Falls, SD 57110:  On or about and at times prior to June 29, 2021,  the employer did not ensure that each employee engaged in roofing operations were trained to recognize the hazards of working at elevation and trained in the use of fall protection. Employees engaged in roofing activities worked near the edge of a two story, a 6 in 12 pitch roof on a residential home without the use of a fall protection system. This condition exposed employees to a fall in excess of 25 feet.  Abatement Note: The employer shall assure that each employee has been trained, as necessary, by a competent person qualified in the following areas:  a)	The nature of fall hazards in the work area; b)	The correct procedures for erecting, maintaining, disassembling, and inspecting the fall protection systems to be used; c)	The use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used;  d)	The role of each employee in the safety monitoring system when this system is used; e)	The limitations on the use of mechanical equipment during the performance of roofing work on low-sloped roofs; f)	The correct procedures for the handling and storage of equipment and materials and the erection of overhead protection; and g)	The role of employees in fall protection plans; h)	The standards contained in this subpart.  Abatement Note: 1926.503(b)(1) provides that the employer shall verify compliance with paragraph (a) of this section by preparing a written certification record. The written certification record shall contain the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer. If the employer relies on training conducted by another employer or completed prior to the effective date of this section, the certification record shall indicate the date the employer determined the prior training was adequate rather than the date of actual training.

29 CFR  1926.1051(a): A stairway or ladder was not provided at all personnel points of access where there is a break in elevation of 19 inches (48 cm) or more, and no ramp, runway, sloped embankment, or personnel hoist is provided.   (a)Thunder Ridge Construction, LLC at 7436 Twin Pines Court, Sioux Falls, SD 57110:  On or about and at times prior to June 29, 2021, the exposing employer did not ensure a ladder was provided to access the first floor level to the lower garage area. A break in elevation of 34 inches existed between the two levels. Employees stepped had to climb from the concrete garage floor to the first floor of the structure without a ladder. This condition exposed employees to fall hazards of 3 feet 6 inches.
