29 CFR  1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles:  (a)Thunder Ridge Construction, LLC at 4920 East Rosa Parks Place, Sioux Falls, SD 57110: On or about and at times prior to February 28, 2023, the employer did not ensure that each employee that was installing roof trusses with the use of a pneumatic nail gun was protected from flying particles by the use of appropriate eye protection.  This condition exposed employees to struck-by hazards.

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladders side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  (a)Thunder Ridge Construction, LLC at 4920 East Rosa Parks Place, Sioux Falls, SD 57110: On or about and at times prior to February 28, 2023, the exposing employer did not ensure that the 300-pound Louisville Fiberglass 6-foot A-frame ladder, Model #: FXS1506 and Little Giant Aluminum Multipurpose step ladder, that the employees were using was extended at least three feet above the upper landing surface of the framed wall top plates of a commercial building.  This condition exposed employees to fall hazards greater than six feet.

29 CFR  1926.1053(b)(13):The top or top step of a stepladder was used as a step:  (a)Thunder Ridge Construction, LLC at 4920 East Rosa Parks Place, Sioux Falls, SD 57110: On or about and at times prior to February 28, 2023, the employer did not ensure that employees were not utilizing the top step of the 300-pound Louisville Fiberglass 6-foot A-frame ladder, Model #: FXS1506 and Little Giant Aluminum Multipurpose step ladder.  Employees were using the step ladder to access the upper landing surface of the north and south top plates of the commercial buildings framed walls and the bottom chord of the trusses to conduct framing operations.  This condition exposed employees to fall hazards greater than six feet.

29 CFR  1926.20(b)(2):The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them:  (a)Thunder Ridge Construction, LLC at 4920 East Rosa Parks Place, Sioux Falls, SD 57110: On or about and at times prior to February 28, 2023, the exposing employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. Employees were conducting framing operations on a commercial property without the use of a fall protection system, not using properly installed ladders while accessing and egressing the top plates of framed walls, and a lack of Personal Protective Equipment (PPE).  This condition exposed employees to fall and struck-by hazards.  Thunder Ridge Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard which was contained in OSHA inspection number 1538753, citation number 1, item number 1, and was affirmed as a final order on October 27, 2021, with respect to a workplace located at 7436 Twin Pines Court, Sioux Falls, SD 57110.

Thunder Ridge Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard which was contained in OSHA inspection number 1538753, citation number 1, item number 2a, and was affirmed as a final order on October 27, 2021, with respect to a workplace located at 7436 Twin Pines Court, Sioux Falls, SD 57110.
