29 CFR 1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns:  a) Building Exterior Lodaing dock: Employees without any head protection engaged in saw cutting and jack hammering a concrete block wall were exposed to head injuries, on or about 7/14/2021. 29 CFR 1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a) Building Exterior Loading dock: Employees were exposed to eye/face injuries while cutting a concrete block wall using a hand held STIHL saw and were not protected with any type of eye/face protection, on or about 7/14/21.

29 CFR 1926.150(a)(1): The employer did not develop and maintain a fire protection program to be followed throughout all phases of construction and demolition work, and/or did not provide for the firefighting equipment as specified in this subpart:  a) JD Phoenix Inc, does not ensure that employees have available firefighting equipment at the jobsite. This violation was most recently observed at 61-65 kuller Ave clifton NJ. The employer did not provide any firefighting equipment at the jobsite. Gasoline fueled demo saw was used.  Extra gasoline to fuel the demo saw was stored in gas cans on the site, on or about 7/14/21.

29 CFR 1926.451(b)(1): Each platform on all working levels of scaffolds was not fully planked or decked between the front uprights and the guardrail supports as specified in paragraphs 1926.451(b)(1)(i)-(ii)  a) Building Exterior loading dock: Employees were exposed to an 6 to 10 foot fall hazard while working from a frame scaffold with missing planks. Scaffold was not fully decked or planked, on or about 7/14/21/21.

29 CFR  1926.451(f)(3):Scaffold and scaffold components were not inspected for visible defects by a competent person before each workshift and after any occurrence which could affect a scaffold's structural integrity:  Scaffold Planks: Employees were using damage scaffold planks that were never inspected for visible defects by a competent person before each workshift. Scaffold planks were never inspected, planks show really bad deterioration, on or about 7/14/21.
