29 CFR 1910.178(p)(1):Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating condition(s). On or about July 28, 2021, the employer failed to remove a forklift from service after multiple deficiencies had been identified. The Big Joe V15 forklift did not have a functioning horn, had faulty headlights and strobe lights, and badly worn tread on the tires. These conditions exposed employees working in the area to struck-by hazards. No abatement certification or documentation required for this item.
