29 CFR  1926.200(g)(2):Traffic control signs or devices used for protection of construction workers did not conform to Part VI of the Manual of Uniform Traffic Control Devices (AMUTCD"), 1988 Edition, Revision 3, September 3, 1993, FHWA-SA-94-027 or Part VI of the Manual on Uniform Traffic Control Devices, Millennium Edition, December 2000, FHWA.(a)(LOCATION)(DESCRIBE THE HAZARD)(WHAT WAS WRONG WITH SIGN)(STATE POSSIBLE INJURIES)  On or about August 4, 2021, traffic control signs or devices used for protection of construction workers did not conform to Part VI of the Manual of Uniform Traffic Control Devices.  Traffic was directed into the work zone, exposing employees to struck-by hazards.  Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR  1926.651(k)(1):An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift:  On or about August 4, 2021, the excavation and adjacent areas were not inspected by a competent person, exposing employees to struck-by hazards from possible cave-ins and trench collapse.  Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR  1926.652(b)(3)(iii):Tabulated data, identifying the registered professional engineer who approved the data, was not maintained at the jobsite during construction of the protective system.  After that time, that data was not made available to the Secretary when requested.  On or about August 4, 2021 at the time of construction, tabulated data was not maintained at the job site or available upon request, exposing workers to struck- by hazards as the box was improperly constructed and installed.  Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR  1926.652(d)(2):Manufactured materials and equipment used for protective systems were not used and maintained in a manner that was consistent with the recommendations of the manufacturer:  On or about August 4, 2021, the employer did not use manufactured materials for their protective systems, exposing employees to struck- by hazards.  Wire ties were used to secure the spreader pins instead of the manufacturer recommended cotter pins.  Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR  1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  On or about August 4, 2021 workers entering a trench used a portable ladder that did not extend three feet past the landing surface, exposing workers to a fall of 9 foot fall.  Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).
