29 CFR  1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:  (a) ISOLATION ROOM:  On or about August 9, 2021 employees were required to wear N-95 respirators and there was no written program in place, exposing employees to hazards from improper usage and handling. The employer required the employee[s] to wear N95 filtering facepiece respirators to protect against the SARS-CoV-2 virus while working in the isolation room.

29 CFR  1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:       (a) ISOLATION ROOM:  On or about August 9, 2021 employees were required to wear N-95 respirators and had not been medically evaluated for respirator usage, exposing employees to hazards from conditions aggravated by wearing a respirator.  The employer required the employee[s] to wear N95 filtering facepiece respirators to protect against the SARS-CoV-2 virus while working in the isolation room.

29 CFR  1910.134(f)(1): The employer did not ensure that employee(s) required to use a tight-fitting facepiece respirator passed the appropriate qualitative fit test (QLFT) or quantitative fit test (QNFT):(a) (LOCATION) (IDENTIFY SPECIFIC OPERATION/CONDITION) (DESCRIBE HAZARD)   (a) ISOLATION ROOM:  On or about August 9, 2021 employees were required to wear N-95 respirators and had not been fit-tested, exposing employees to hazards from improper fit. The employer required the employee[s] to wear N95 filtering facepiece respirators to protect against the SARS-CoV-2 virus while working in the isolation room.

29 CFR  1960.66(b):Federal agency injury and illness recording and reporting shall comply with the requirements under 29 CFR 1904, subparts C, D, E, and G, except that the definition of "establishment" found in 29 CFR 1960.2(h) will remain applicable to Federal agencies.  29 CFR  1904.40(a) reference: The employer had not provided an authorized government representative the records within the four business hours. 29 CFR  1904.4(a)reference: The employer had not recorded each work-related fatality, injury or illness case that resulted in the general recording criteria on the OSHA Form 300 or equivalent.  TUBA CITY BOARDING SCHOOL: On or about August 11, 2021, the employer failed to provide copies of the requested injury and illness records for calendar years 2018, 2019, 2020 and 2021 to an authorized OSHA representative when requested both verbally and in writing as the employer had not kept records.  The Bureau of Indian Education was previously cited for a violation of this  occupational safety and health standard or its equivalent standard 29 CFR  1960.66(b),  which was contained in OSHA inspection number 1502674, citation number 2, item number 2, issued on January 19, 2021, which was affirmed as a final order on March 12, 2012 with respect to a workplace located at Navajo Rte. 27, 18 mi N. of Ganado, Ganado, AZ, 86505.    Abatement Certification and Documentation is required
