29 CFR  1910.1200(e)(1):  This standard is applicable to construction employment as defined by 1926.59.  The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met.   The employer is failing to protect employees from hazardous chemicals by not having a written hazardous communication program - This was most recently documented on or about August 17th 2021 at 16634 Whittmore in Bennington, Nebraska.  Chemicals in use at the jobsite such as, but not limited to,  acrylic latex adhesive sealant.

Employers did not have a safety data sheet in the workplace for each hazardous chemical which they use:   The employer is failing to protect employees from hazardous chemicals by not maintaining the required safety data sheets for the hazardous chemical that was being used in the workplace. This was most recently documented on or about August 17th 2021 at 16634 Whittmore, Bennington,  Nebraska. The hazardous chemical used at the jobsite such as, but not limited to,  Acrylic latex adhesive sealant.

Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area.  The employer is failing to protect employees from hazardous chemicals by not providing employees with effective information and training on the hazardous chemical used in the workplace - This was most recently documented on or about August 17th, 2021 at 16634 Whittmore, Bennington , Nebraska.  Chemicals in use at the jobs site such as, but not limited to, acrylic latex adhesive sealant.

29 CFR  1926.100(a):Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets.  The employer is failing to protect employees from struck-by hazards. This was most recently documented on or about August 17th 2021, Bennington, Nebraska. An employee was working directly below employees that were engaged in residential framing activity on top of the roof.  The approximate height of the workers that were working on the roof was over 11ft.

29 CFR  1926.416(e)(1):Worn or frayed electric cords or cables were used.  The employer is failing to protect employees from electrical shock. This was most recently documented on or about August 17th, 2021 at 16634 Whittmore, Bennington, Nebraska. Employees are using extension cords that have damaged sheathing that generate electricity to their power tools that were being used on the job site.

29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system.   The employer is failing to protect employees from fall hazards associated with roofing/framing operations.  An employee was observed working on a roof at height greater than 6ft. The most recent occurrence of this was evident during the inspection of the job site located at 16634 Whittmore, Bennington,  NE 68101 -  The CSHO observed an employee on a roof that wasn't utilizing any fall protection.
