29 CFR 1910.178(l)(2)(ii): This standard is applicable to construction employment as defined by 1926.59. Employees were engaged in activities related to framing at a new construction residential building located at 6310 N. 170th Ave., Omaha, NE 68118, was exposed to struck-by and fall hazards in that the employees were not instructed in the recognition of the hazards associated with operating a powered industrial truck near employees or with a powered industrial truck mounted scaffold, and the methods to mitigate those hazards.

29 CFR 1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected. Employees engaged in roofing activities at a new construction residential building located at 6310 N. 170th Ave., Omaha, NE 68118, were exposed to fall hazards in that the employees, although wearing harnesses, were not tied off to prevent falling to lower level.
