29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c):  (a)MDM Construction, LLC at 2501 West 22nd Street, Sioux Falls, SD 57105:  On or about and at times prior to August 17, 2021, the controlling employer failed to ensure subcontractor employees were protected from cave-in and struck-by hazards while working within an excavation deeper than five feet. On August 17, 2021, subcontractor employees accessed a trench excavation measuring 8-foot 4 inches to 17 feet in depth with near vertical walls to install formwork for a steam line. The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i), in that the bench and maximum allowable slope associated with Type B soil were not at an angle of 45 degrees.   This condition exposed employees to a cave-in and struck-by hazard associated with working in an unprotected trench excavation.
