29 CFR  1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular effective inspections of jobsites, materials, and equipment to be made by a competent person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees:  (a)MDM Construction, LLC at 2501 West 22nd Street, Sioux Falls, SD 57105: On or about and at times prior to May 9, 2023, the controlling employer did not ensure that frequent and regular inspections were conducted by a competent person in that subcontracted employees were exposed to cave-in hazards while working within an unprotected excavation that measured greater than five feet in depth.  This condition exposed subcontracted employees to cave-in and struck-by hazards associated with excavation wall collapse.
