29 CFR  1910.178(l)(1)(i):The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  At the Metal Shop, employees engaged in material handling activities operating forklifts were exposed to struck-by hazards in that the employer did not certify that the forklift operators had not been provided formal instruction or given an evaluation of the operator's performance prior to operating forklifts.

29 CFR  1910.212(a)(1):One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:  In the Metal Shop, employees engaged in manufacturing activities, were exposed to amputation and struck-by hazards in that the point of operation was not guarded at the Milwaukee Electromagnetic Drill Press.  FCA LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.212(a)(1), which was contained in OSHA inspection number 1344108, citation number 1, item number 2 and was affirmed as a final order on 10.09.2018, with respect to a workplace located at 2348 FM 464 Seguin, TX 78155.  FCA LLC dba Crate Tech was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.212(a)(1), which was contained in OSHA inspection number 1270050, citation number 1, item number 1 and was affirmed as a final order on 01.23.2018, with respect to a workplace located at 8110 E Marion St. Wichita, KS 67210.
