29 CFR  1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns:  a. On or about 05/12/2021- #43 Bonaire Circle, Suffern NY 10901- Employees engaged in roof removal and sheathing activities were discarding   roofing debris from the roof to the ground below exposing employees at ground level to overhead impact hazards as head protection was not being utilized.     b. On or about 05/12/2021 #43 Bonaire Circle, Suffern NY 10901- Sheets of plywood were being conveyed to the roof by a Material Hoist exposing employees operating and receiving the  plywood sheets to overhead impact hazards in which head protection was not utilized.

29 CFR  1926.102(a)(1): Employees did not use eye and face protection equipment when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:  a. On or about 05/12/2021- #43 Bonaire Circle, Suffern NY 10901Employees used an electrical circular saw, electric miter saw and a pneumatic nail gun, without eye protection. The employees using the tools were exposed to flying debris, including flying plywood, flying roofing materials, and nails that could cause injury or loss to an eye.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system.   The employer does not require the use of any form of fall protection when employees are performing residential construction activities 6 feet or more above lower levels. The violation was recently observed on or about May 12, 2021, at a residential construction site located at or near #43 Bonaire Circle, Suffern, New York 10901, where two employees were not protected from fall hazards of approximately eighteen feet to the ground. To abate this violation, the employer must ensure that its employees performing residential construction activities 6 feet or more above lower levels are protected from falls, and that no employee is allowed to perform residential construction activities at heights greater than 6 feet above lower levels without adequate fall protection.  Pursuant to 29 CFR 1903.19, within 30 days the employer must submit documents describing the steps it is taking to ensure Compliance, including a description of how these steps protect its employees from fall hazards
