29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: 57 Wire Village Rd, Spencer MA: (a) On or about 11/18/21, employees polishing aluminum parts were exposed to 175.1 %, 186.3 %, 199.8 %, and 227.4 % of the permissible exposure limit (PEL) for noise, which is equivalent to 94.0 dBA, 94.4 dBA, 94.9 dBA, and 95.0 dBA, respectively, as 8-hour time-weighted averages, and the employer did not administer a continuing, effective hearing conservation program. (b) On or about 11/18/21, an employee polishing aluminum parts was exposed to 147.3 % of the action level (AL) for noise, which is equivalent to 92.7 dBA as an 8-hour time-weighted average, and the employer did not administer a continuing, effective hearing conservation program.
