29 CFR  1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b):  (a) Capital Roofing, LLC at 6101 North Gold Nugget Avenue, Sioux Falls, SD  57104: On or about and at times prior to September 27, 2021, the employer did not ensure that employees were protected from falls while conducting roofing operations on a residential home. This condition exposed employees to fall hazards greater than six feet.

29 CFR  1926.503(a)(1):The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  (a) Capital Roofing, LLC at 6101 North Gold Nugget Avenue, Sioux Falls, SD  57104: On or about and at times prior to September 27, 2021, the employer did not ensure that employees were properly trained on the use of fall protection systems prior to being exposed to the fall hazards while working on a residential roof.  This condition exposed employees to fall hazards greater than six feet.

29 CFR  1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  (a) Capital Roofing, LLC at 6101 North Gold Nugget Avenue, Sioux Falls, SD  57104: On or about and at times prior to September 27, 2021, the employer did not ensure that the ladder the employees were using was extended at least three feet above the upper landing surface of the eave of the residential roof.  This condition exposed employees to fall hazards greater than ten feet.

This exposed the employees to fall hazards greater than 10 feet.
