29 CFR  1910.22(d)(2):29 CFR 1910.22(d)(2): The employer did not ensure that hazardous conditions on walking-working surfaces are corrected or repaired before an employee uses the walking-working surface again. The employer did not ensure that if the correction or repair cannot be made immediately, the hazard is guarded to prevent employees from using the walking-working surface until the hazard is corrected or repaired.  Employees were exposed to struck-by hazards. Employees engaged in forklift and manufacturing operations in the old Checkers building were exposed to struck by hazards in that damage on the walking-working surface was not corrected or repaired before employee use. Employees were exposed in that walk-working surfaces where forklifts travel had damage that could alter forklift travel paths and cause unsecured loads to become a hazard to employees.

29 CFR  1910.178(g)(2):Facilities were not provided for flushing and neutralizing spilled electrolyte, for fire protection, for protecting charging apparatus from damage by trucks, and/or for adequate ventilation for dispersal of fumes from gassing batteries;  Employees were exposed to health hazards. Employees engaged in powered industrial truck activities were exposed to health hazards in that the employer had not provided a spill kit or other means of battery acid containment within their workplace.
