29 CFR  1926.20(b)(2):The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person:  JOB SITE: Mid Rivers Apartments (New Construction), St. Peters Parkway, Saint Peters, MO 63376, on or about 10/26/2021, Amigo Roofing & Contracting, LLC, the general contractors and controlling employer did not conduct an adequate inspection of the job site, materials, and equipment. Employees were exposed to the following hazards:  a) A Roofing subcontractor was actively installing new roof shingles on a 2-story Apartment complex (New Construction) without any form of fall protection and were operating pneumatic nail guns without eye or face protection. b) A Siding subcontractor was cutting siding to size on a table saw without machine guard. The same subcontractor and helper were operating the table saw without eye or face protection. c) The General Contractor provided the siding subcontractor the use of an orange electrical extension cord to power the table saw, with the strain relief detached from the male plug.

29 CFR  1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles:  JOB SITE:  Mid Rivers Apartments (New Construction), St. Peters Parkway, Saint Peters, MO 63376, on or about 10/26/2021, workers were observed operating a Craftsman 10" Table Saw, Model: 13_42080, S/N: RUQ3146, 120v, 5,000rpm, actively cutting siding, without any form of eye of face protection.  The workers were exposed to struck-by hazard.

The workers were exposed to a fall hazard.

29 CFR  1926.503(a)(1):The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  JOB SITE: Mid Rivers Apartments (new construction), St. Peters Parkway, Saint Peters, MO, on or about 10/26/2021, the employer did not ensure that each employee on a 5:12 pitch roof, a 2-story structure, was trained to recognized the hazards of falling and the procedures to be followed in order to minimize these hazards. The employer failed to protect their employees by not providing fall protection training.

29 CFR  1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  JOB SITE: Mid Rivers Apartments (new construction), St. Peters Parkway, Saint Peters, MO, on or about 10/26/2021, the employer did not ensure that each employee using an Aluminum Extension Ladder (no marking) was installed properly to prevent a fall hazard. The ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed.
