29 CFR 1926.501(b)(10):Each employee was engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, employees were not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system. On or about March 10, 2023, employees were exposed to fall hazards of approximately 14 feet from a single story commercial roof while performing roofing activities and a suitable fall protection system was not used.

29 CFR 1926.1053(b)(1):Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access. On or about March 3, 2023, eight employees were observed using a ladder to access and exit the landing of the commercial roof and the side rails did not extend at least three feet above the roof access. Amigo Roofing & Contracting, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 1926.1053(b)(1), which was contained in OSHA inspection number 1560531, citation number 1, item number 5 and was affirmed as a final order on (February 9, 2022), with respect to a workplace located at Mid Rivers Apartments, Saint Peters, MO, 63376.
