29 CFR  1926.20(b)(1):It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a. Located at 5716 Datura Lane in Westerville, Ohio: On or about November 30, 2021, the employer failed to maintain an effective safety and health program to ensure that hazards were identified and corrected onsite while employees performed roofing work.   Florentino Velasco was previously cited for a Repeat violation of this Occupational Safety and Health standard 29 CFR 1926.20(b)(1) which was contained in OSHA inspection number 1532789, citation number 1, item number 1 and was affirmed as a final order on 06/29/2021, with respect to a workplace located at 2384 Vineyard Road, Columbus, Ohio 43220.  Florentino Velasco DBA Florentino Roofing was previously cited for a Repeat violation of this Occupational Safety and Health standard 29 CFR 1926.20(b)(1) which was contained in OSHA inspection number 1477518, citation number 1, item number 1 and was affirmed as a final order on 07/24/2020, with respect to a workplace located at 551 Buchloe Drive, Lot 6900, Marysville, Ohio 43040.  Florentino Velasco was previously cited for a Serious violation of this Occupational Safety and Health standard 29 CFR 1926.20(b)(1) which was contained in OSHA inspection number 1412819, citation number 1, item number 1 and was affirmed as a final order on 09/03/2019, with respect to a workplace located at Lot 7500, Hilliard, Ohio 43026.

Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.   a. Located at 5716 Datura Lane in Westerville, Ohio: On or about November 30, 2021, the employer failed to ensure that employees performing roofing work onsite were protected from falls from the roof, thereby exposing employees to fall hazards from approximately twenty feet.   Florentino Velasco was previously cited for a Repeat violation of this Occupational Safety and Health standard 29 CFR 1926.501(b)(13) which was contained in OSHA inspection number 1501652, citation number 1, item number 3 and was affirmed as a final order on 04/12/2021, with respect to a workplace located at 243 Winter Shadow Loop, Delaware, Ohio 43015. 29 CFR  1926.1053(b)(1):When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support.  a. Located at 5716 Datura Lane in Westerville, Ohio: On or about November 30, 2021, the employer did not ensure that the extension ladder employees used to access the second story roof extended at least three feet above the roof's eave, thereby exposing employees to a fall hazard from approximately twenty feet.
