29 CFR 1910.178(l)(1)(i):The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): The employer failed to provide powered industrial truck training to a sanitation worker operating a Raymond stand up reach forklift in the cooler warehouse located at 1915 East Kansas City Road, Olathe, Kansas. The sanitation worker operating a Raymond stand up forklift struck a stack of pallets in aisle CD causing the employee to be fatally injured.

29 CFR 1910.178(m)(4): Industrial truck drivers were not prohibited from placing extremities outside the running lines of the truck. The employer failed to ensure the operator of the Raymond stand up reach forklift kept his extremities inside the running lines of the truck in the cooler warehouse located at 1915 East Kansas City Road, Olathe, Kansas. The sanitation worker operating a Raymond stand up forklift operated the forklift with extremities outside the running lines of the truck, causing the employee to be fatally injured.
