OSH ACT of 1970 Section (5)(a)(1):  The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards as a result of structural damage to steel shelving storage racks in the following areas:  (a)  Employees loading / unloading pallets of materials into steel storage racks in the dry section of the warehouse  located at 1915 Kansas City Road, Olathe, Kansas, where a column post between HB-78-A1 and HB-76- C1 was structurally damaged, thus exposing workers to an unstable storage rack unit.   The column post was leaning approximately 4 inches from center.    (b)   Employees loading / unloading pallets of materials into steel storage racks in the dry section of the warehouse  located at 1915 Kansas City Road, Olathe, Kansas, where cross bracing was missing from upper section of the storage rack HB-52-A1.  The cross bracing was missing from the north and east side of the storage rack, at the center cross aisle.  (c)   Employees loading / unloading pallets of materials into steel storage racks in the dry section of the warehouse  located at 1915 Kansas City Road, Olathe, Kansas, where a column post between DV-26-C1 and DV-28- A1 was structurally damaged, thus exposing workers to an unstable storage rack unit.   The column post was leaning approximately 1 inch from center.    (d)  Employees loading / unloading pallets of materials into steel storage racks in the dry section of the warehouse  located at 1915 Kansas City Road, Olathe, Kansas, where a column post between DV-66-A1 and DV-64- C1 was structurally damaged, thus exposing workers to an unstable storage rack unit.   The column post was leaning approximately 3-5/8 inches from center.   (e)   Employees loading / unloading pallets of materials into steel storage racks in the dry section of the warehouse  located at 1915 Kansas City Road, Olathe, Kansas, where a column post between DS-11-C1 and DS-13- A1 was structurally damaged, thus exposing workers to an unstable storage rack unit.   The column post was leaning approximately 1/2 inch from center.   (f)   Employees loading / unloading pallets of materials into steel storage racks in the dry section of the warehouse  located at 1915 Kansas City Road, Olathe, Kansas, where a column post between DS-51-C1 and DS-53-A1 was structurally damaged, thus exposing workers to an unstable storage rack unit.   The column post was leaning approximately 1-1/2 inches from center.   (g)    Employees loading / unloading pallets of materials into steel storage racks in the dry section of the warehouse  located at 1915 Kansas City Road, Olathe, Kansas, where a column post between DK-32-A1 and DK-30- C1 was structurally damaged, thus exposing workers to an unstable storage rack unit.   The column post was leaning approximately 3 inches from center.    (h)   Employees loading / unloading pallets of materials into steel storage racks in the dry section of the warehouse  located at 1915 Kansas City Road, Olathe, Kansas, where a column post between DI-11-C1 and DI-13- A1 was structurally damaged, thus exposing workers to an unstable storage rack unit.   The column post was leaning approximately 3 inches from center.     (i)   Employees loading / unloading pallets of materials into steel storage racks in the dry section of the warehouse  located at 1915 Kansas City Road, Olathe, Kansas, where a column post between DG-11-C1 and DG-13-A1 was structurally damaged, thus exposing workers to an unstable storage rack unit.   The column post was leaning approximately 3 inches from center.   (j)    Employees loading / unloading pallets of materials into steel storage racks in the dry section of the warehouse  located at 1915 Kansas City Road, Olathe, Kansas, where cross bracing was missing from the end cap of the storage rack DF-40-B1.    (k)  Employees loading / unloading pallets of materials into steel storage racks in the cooler section of the warehouse  located at 1915 Kansas City Road, Olathe, Kansas, where a column post between CC-08-A1 and CC-10- C1 was structurally damaged, thus exposing workers to an unstable storage rack unit.   The column post was leaning approximately 4 inches from center.   (l)  Employees loading / unloading pallets of materials into steel storage racks in the cooler section of the warehouse  located at 1915 Kansas City Road, Olathe, Kansas, where a column post between CJ-11-C1 and CJ-13- A1 was structurally damaged, thus exposing workers to an unstable storage rack unit.   The column post was leaning approximately 2-1/2 inches from center.   (m)  Employees loading / unloading pallets of materials into steel storage racks in the cooler section of the warehouse  located at 1915 Kansas City Road, Olathe, Kansas, where cross bracing was structurally damaged.  The cross bracing was bent outward from storage rack CJ-09-A1.  (n)  Employees loading / unloading pallets of materials into steel storage racks in the cooler section of the warehouse  located at 1915 Kansas City Road, Olathe, Kansas, where a column post between CH-09-C1 and CH-11-A1 was structurally damaged, thus exposing workers to an unstable storage rack unit.   The column post was leaning approximately 3/4 inch from center.   (o)  Employees loading / unloading pallets of materials into steel storage racks in the cooler section of the warehouse  located at 1915 Kansas City Road, Olathe, Kansas, where a column post between CH-07-C1 and CH-09- A1 was structurally damaged, thus exposing workers to an unstable storage rack unit.   The column post was leaning approximately 1/2 inch from center.   Among other methods, one feasible and acceptable method to correct this hazard is to develop and implement a structural integrity program to regularly inspect storage racks as recommended by the Rack Manufacturers Institute Specification for the Design, Testing, and Utilization of Industrial Steel Storage Racks 1997 Edition, Section 1.4.1

29 CFR  1910.303(g)(2)(i):Live parts of electric equipment operating at 50 volts or more were not guarded against accidental contact by approved cabinets or other forms of approved enclosures, or other means listed under this provision:   (a) Employees using the break room closet located at 1915 Kansas City Road, Olathe, Kansas were exposed to electrical hazards due to the wiring inside the outlet box on the west wall, being energized without a protective cover.  (b)  Employee(s) and subcontractors using a dock light at dock door 51 located at 1915 Kansas City Road, Olathe, Kansas were exposed to electrical hazards due energized electrical equipment not being guarded from contact with workers.
