29 CFR 1926.501(b)(2)(i): Each employee who was constructing a leading edge 6 feet or more above lower levels was not protected from falling by guardrail systems, safety net systems, or personal fall arrest systems: Note: If the employer could demonstrate that it was infeasible or created a greater hazard to use these systems, a fall protection plan meeting the requirements of paragraph (k) of 1926.502 should have been developed and implemented. (a) On or about January 13, 2022, employees conducted re-roofing work on a commercial storage building without the use of fall protection, exposing employees to a fall hazard of approximately 11 feet. Semper Fi Roofing, Inc. was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard (29 CFR 1926.501(b)(13)), which was contained in OSHA inspection number 1343380, citation number 1, item number 2a and was affirmed as a final order on October 3, 2018, with respect to a workplace located at S47 W25715 Wood Lilly Lane in Waukesha, Wisconsin 53189.
