29 CFR 1910.178(l)(2)(i): Trainees may operate a powered industrial truck only: (A) Under the direct supervision of persons who have the knowledge, training, and experience to train operators and evaluate their competence; and (B) Where such operation does not endanger the trainee or other employees. On or about January 28, 2022, and at times prior thereto, (B) the employer did not ensure forklift training was safely conducted as not to endanger the trainees and all other employees exposing them to crush-by and/or struck-by hazards.

29 CFR 1910.178(q)(7): Industrial trucks shall be examined before being placed in service and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected. On or about January 28, 2022, and at times prior thereto, the employer did not ensure forklifts No. 10 and No. 18 used for training were inspected by warehouseman prior to use. Warehouse employees were potentially exposed to crush-by and/or struck-by hazards.
