29 CFR 1926.501(c): When employees were exposed to falling objects the employer did not verify employees were wearing hard hats and did not implement measures to prevent objects from falling from higher levels as set forth in (c)(1)-(3) of this section: On or about February 8, 2022, at the south porch of the concrete deck, the employer did not ensure toeboards were erected and verify the exposed employees were wearing protective helmets. This exposed the employee to a struck-by hazard.

On or about February 8, 2022, at a north porch roof, the employer did not ensure the safety monitor for fall protection was on the same working surface as the monitored employee. This exposed the employee to a fall greater than 6 feet to a lower level.

29 CFR 1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder. On or about February 8, 2022, at a north porch roof, the employer did not ensure an employee used a portable ladder that is secured at its top to a rigid support when the ladder side rails did not extend at least 3 feet above the upper landing surface. This exposed the employee to a fall hazard. Mid-America Roofing & Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.1053(b)(1), which was contained in OSHA inspection number 1326570, citation number 1, item number 2 and was affirmed as a final order on July 28, 2018, with respect to a workplace located at 721 W. Britton Road, Oklahoma City, OK 73114.
