Maintenance employees regularly performed servicing and maintenance on equipment that required the use of lockout/tagout. This condition exposed employees to amputation hazards and hazardous energy.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: (a) Tenere Inc. at 1100 W 120th Avenue in Westminster, Colorado: On or about February 20, 2022, and at times prior, the employer did not ensure the rotating parts of the Nomura Boring Mill were properly guarded. This could result in employees becoming entangled in the equipment and parts of the body being crushed. (b) Tenere Inc. at 1100 W 120th Avenue in Westminster, Colorado: On or about February 20, 2022, and at times prior, the employer did not ensure the pinch points created by the belt and pulley of the Baldor sand belt were properly guarded. This exposed workers to amputation hazards.

29 CFR 1910.147(c)(5)(ii): Lockout devices and tagout devices were not used for lockout and tagout purposes only: (a) Tenere Inc. at 1100 W 120th Avenue in Westminster, Colorado: On or about February 20, 2022, and at times prior, the employer did not ensure that lockout devices were used only for the purpose of servicing and maintenance of machines and equipment. A lockout/tagout lock was placed on the Baldor pedestal grinder when the equipment was not in use as an operational control to prevent unauthorized employees from using the grinder and not related to servicing or maintenance.
