29 CFR  1926.501(b)(13):  Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system:  a) 21 Fairfield Terrace., Longmeadow, MA: On or about March 14, 2022,  Three  employees were observed roofing the main roof of this residence which was  more than 19 feet above the ground below and none of the employees were protected by guardrail systems, safety net system, or personal fall arrest system.   b) 21 Fairfield Terrace., Longmeadow, MA: On or about March 14, 2022,  one  employee was observed roofing  on a side roof of this residence which was  more than 10 feet above the ground below and the employee was  not protected by guardrail systems, safety net system, or personal fall arrest system.   Specific abatement documentation that this violation has been corrected must be provided within 10 days of the abatement in accordance with 29 CFR 1903.19 (d)(1).

29 CFR  1926.503(a)(1):The employer did not provide a training program for each employee who was exposed to fall hazards:  21 Fairfield Terrace., Longmeadow, MA:  On or about March 14, 2022 4 employees were observed roofing this residence and were  exposed to fall hazards are part of their assigned duties and the employer had not trained them prior to exposure to these hazards in topics such as but not limited to recognition of fall hazards, dangers of fall hazards and procedures each employee must take to prevent or minimize risk of such exposures.  Specific abatement documentation that this violation has been corrected must be provided within 10 days of the abatement in accordance with 29 CFR 1903.19 (d) (1).  The employer routinely does not assure effective protection against falls as required by the standard, as demonstrated on November 16, 2021, when his untrained employees, for whom he had not created a written fall protection certification record were roofing a residence located at 138 Abbott St., Springfield, MA and were exposed to fall hazards of more than 15 feet 11 inches above the next lower level (ground).

29 CFR  1926.503(b)(1):The employer did not verify compliance with paragraph (a) of this section by preparing a written certification record:  21 Fairfield Terrace., Longmeadow, MA: On or about March 14, 2022 the employer not prepared a written certification record of fall protection training which included the name or other identity of the person trained,  the signature of the person trained, date(s) the training was completed and the signature of the person who conducted the training.  Specific abatement documentation that this violation has been corrected must be provided within 10 days of the abatement in accordance with 29 CFR 1903.19 (d) (1).  The employer routinely does not assure effective protection against falls as required by the standard, as demonstrated on November 16, 2021, when untrained employees were installing shingles on a residential roof located at 138 Abbott St., Springfield, MA without fall protection. Employees were exposed to fall hazards of more than 15 feet 11 inches above the next lower level.

29 CFR  1926.1053(b)(1):When portable ladders were used for access to an upper landing surface, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:  a) 21 Fairfield Terrace., Longmeadow, MA: On or about March 14, 2022 3 employees were observed accessing the  main roof of this residence using an aluminum extension ladder that did not extend 3 feet past that upper landing surface.  b) 21 Fairfield Terrace., Longmeadow, MA: On or about March 14, 2022 1  employees were observed accessing the side roof of this residence using an aluminum extension ladder that did not extend 3 feet past that upper landing surface.    Specific abatement documentation that this violation has been corrected must be provided within 10 days of the abatement in accordance with 29 CFR 1903.19 (d)(1).  The employer routinely does not assure effective protection against falls as required by the standard, as demonstrated on November 16, 2021, when his  employees were using ladders that did not extend 3 feet past the upper landing surface they were accessing  to  install shingles on a residential roof located at 138 Abbott St., Springfield, MA without fall protection. Employees were exposed to fall hazards of more than 15 feet 11 inches above the next lower level (ground).
